How it works

1. Contact us by filling out the short form on the right or by telephone (on 0114 249 3222 or 01246 555387) or email (at enquiries@metcalfedavideyres.co.uk).

2. Once you’ve contacted us, you will be allocated to one of our fully qualified solicitors.

3. We will then obtain full details of the claim from you, including the relevant circumstances, the injuries sustained and any out of pocket expenses suffered, as well as considering funding.

4. We will then forward to you initial documentation for you to complete and return before submitting your claim to the Defendant/Defendant’s insurers or, for a Medical Negligence matter, obtaining your medical notes and records.

5. Your legal advisor will then deal with each step of the claim process, all the time keeping you fully updated.

6. Once the Defendant’s insurers reply to the submitted claim, the response received in respect of liability will be explained to you in detail.

7. When required, usually around 2 months from the date of the incident, a detailed update in respect of your symptoms will be obtained from you, which could be face to face, over the telephone or via post or email depending on your preference, before a medical expert is instructed to examine you and provide a medical report to fully document your injuries. Further details of your out of pocket expenses will also be obtained with a view to these being documented, usually by way of a calculation schedule.

8. Once final evidence in support of your claim has been obtained, full details will be provided to the Defendant’s insurers and negotiations entered into.

9. When the Defendant’s insurers reply with their offer of settlement, your legal advisor will provide views upon this and how it should be responded too.

10. When you’re happy with the offer of settlement made, this will be accepted on your behalf and shortly after you will receive your compensation.

There are times when liability will not be admitted, or you are not happy with the offer of compensation put forward, and in those unlikely scenarios, it will be necessary to consider the issue of court proceedings. If this is required, again, your legal advisor will expertly deal with this and offer you advice all the way up to, and including, a court hearing. Such circumstances are rare, but can happen, though you can feel confident that unfortunately we have seen it, done and got the trial T-shirt.
